The country which runs on Rule of Law can not afford to take Legal Education lightly. Professional degrees call for expert guidance and control. Keeping this in view, the honorable Panjab and Haryana High Court has annulled the appointment of Political Science professor Dr. Sarabjeet Kaur as the Director of University Institute of Legal Sciences.
In a writ petition filed under Article 226 of the Constitution by Dr. Shruti Bedi from UILS it was alleged that the appointment of director has been made in negligence of provisions under Legal Education Rules of 2008 made by Bar Council of India in consonance with the provisions of the Advocate's Act 1961.
The Act mandates that Law schools should be run by people with a background in legal field. University may create its own rules of head rotation but they do not apply to professional degrees such as law.
The High Court's judgement gives regard to the primary principle of Administration that Nothing is above Law. Law governs every aspect of human life from cradle to grave. Therefore the High Court observed that an institution producing future lawyers and judges can not be headed by a non-legal expert. This will infact be a compromise with the justice delivery mechanism. Earlier the Supreme Court had curtailed part time degrees in law to assert that Law is not low, it must be taken seriously.
